Iconic Auctioneers Limited ("IAL", "we" "us" or "our") are committed to safeguarding your privacy. This policy sets out how we will treat your personal information.

We are a data controller for the purposes of the relevant data protection legislation including the Data Protection Act 2018, the General Data Protection Regulations and any subsequent legislation as appropriate ie. we are responsible for and control the processing of your personal information.

What information do we collect?

We may collect, store and use the following kinds of personal information:

  • Information about your computer and about your visits to and use of this website (including your IP address, geographical location, browser type and version, operating system, referral source, length of visit, page views, website navigation);
  • Financial and transactional data relating to any transactions carried out between you and us, relating to any purchases you make of our goods or services.
  • Information that you provide to us for the purpose of registering with us for selling, bidding or buying at auction. In particular, identity and contact data such as name, address, email address and phone number.
  • Information that you provide to us for the purpose of subscribing to our website services, email notifications and/or newsletters.

Anti-Money Laundering

If you decide to enter into a business relationship with IAL, we will require appropriate identity (ID) evidence to be provided such as a current signed passport, driving licence, firearms certificate, National Identity card, utility bill or bank statement issued within the last 3 months.

How long we keep data for

  • General information – we hold this permanently unless otherwise required in writing to do so
  • ID – we keep this for 5 years as per HMRC guidance
  • Accounting information – we keep this for 6 years as per HMRC requirements

Cookies

A cookie consists of information sent by a web server to a web browser and stored by the browser. The information is then sent back to the server each time the browser requests a page from the server. This enables the web server to identify and track the web browser.

We may use both "session" cookies and "persistent" cookies on the website. We will use the session cookies to keep track of you whilst you navigate the website. We will use the persistent cookies to enable our website to recognise you on subsequent visits.

Session cookies will be deleted from your computer when you close your browser. Persistent cookies will remain stored on your computer until deleted, or until they reach a specified expiry date.

We use Google Analytics to analyse the use of this website. Google Analytics generates statistical and other information about website use by means of cookies, which are stored on your computer. The information generated relating to our website is used to create reports about the use of the website. Google will store this information. Our advertisers/payment services providers may also send you cookies.

Use of your personal information

Personal information submitted to us will be used for the purposes specified in this privacy policy and/or in relevant parts of the website and the business. We may use your personal information to:

  • Administer and protect our business and website (including troubleshooting, testing, data analysis, support, system maintenance, reporting and hosting of data);
  • Improve your browsing experience by personalising the website;
  • Enable your use of the services available on the website;
  • Send to you goods purchased and supply to you services purchased;
  • Send statements and invoices to you, and collect payments from you;

Where you submit personal information for publication on our website, we will publish and otherwise use that information in accordance with the licence you grant to us.

E-mail

In order to provide you with information about upcoming auctions and events IAL may send you email notices based on your bidding history expressed interests. To facilitate this service, IAL, may make note of some of the pages you visit on our website.

You may send an email at anytime requesting that your email address be removed from our lists.

Text messages

From time to time we may send text messages via a platform called Esendex. The texts will provide you with the latest information and a link to our website but will not request information from you. It will also provide you with the facility to opt out of receiving text messages from us.

Disclosures

We may disclose information about you to any of our employees, officers, agents, suppliers or subcontractors insofar as reasonably necessary for the purposes as set out in this privacy policy. In addition, we may disclose your personal information:

  • to the extent that we are required to do so by law;
  • in connection with any legal proceedings or prospective legal proceedings;
  • in order to establish, exercise or defend our legal rights (including providing information to others for the purposes of fraud prevention and reducing credit risk);
  • to the purchaser (or prospective purchaser) of any business or asset which we are (or are contemplating) selling; and
  • to any person who we reasonably believe may apply to a court or other competent authority for disclosure of that personal information where, in our reasonable opinion, such court or authority would be reasonably likely to order disclosure of that personal information.

Except as provided in this privacy policy, we will not provide your information to third parties.

International data transfers

Information that we collect may be stored, processed in and transferred between any of the countries in which we operate in order to enable us to use the information in accordance with this privacy policy. Information which you provide may be transferred to countries (including the United States, Japan and other countries) which do not have data protection laws equivalent to those in force in the European Economic Area.

In addition, personal information that you submit for publication on the website, for example in the description of lots, will be published on the internet and may be available, via the internet, around the world. We cannot prevent the use or misuse of such information by others. You expressly agree to such transfers of personal information.

Phishing

Identity theft is a problem and it has become increasingly common for unauthorised individuals to send email messages to consumers purporting to represent a legitimate company or bank or similar, requesting that the consumer provide personal and often sensitive, information. At times the domain name of the email address from which the email appears to have been sent and the domain name of the website requesting this information, appears to be the domain name of a legitimate and trusted company, bank or similar. In reality such sensitive information is received by an unauthorised individual to be used for purposes of identity theft. This illegal activity is known as phishing.

If you receive an email or other correspondence requesting that you provide any sensitive information (including your credit card information and or passwords) via email or to a website that does not seem to be associated with our website, or to one that seems suspicious to you, do not provide such information and please report such requests to our administration department via email to This email address is being protected from spambots. Security of your personal information

We will take reasonable technical and organisational precautions to prevent the loss, misuse or alteration of your personal information. We will store all the personal information you provide on secure (password and firewall) servers. All electronic transactions you make to or receive from us will be encrypted using SSL technology. Data transmission over the internet is inherently insecure and we cannot protected guarantee the security of data sent over the internet. You are responsible for keeping your password and user details confidential. We will not ask you for your password (except when you log in to the website).

Policy amendments

We may update this privacy policy from time-to-time by posting a new version on our website. You should check this page occasionally to ensure you are happy with any changes. We may also notify you of changes to our privacy policy by email.

Your rights

You may instruct us to provide you with any personal information we hold about you. Provision of such information will be subject to the supply of appropriate evidence of your identity (for this purpose, we will usually accept a photocopy of your passport certified by a solicitor or bank plus an original copy of a utility bill showing your current address).

We may withhold such personal information to the extent permitted by law.

You may instruct us not to process your personal information for marketing purposes by email at any time. In practice, you will usually either expressly agree in advance to our use of your personal information for marketing purposes, or we will provide you with an opportunity to opt out of the use of your personal information for marketing purposes.

Third party websites

The website contains links to other websites that are not operated by us. We are not responsible for the privacy policies or practices of third-party websites.

We may contact you via email to invite you to review any services you received from us in order to collect your feedback and improve our services. We use an external company, Trustpilot A/S (“Trustpilot”), to collect your feedback which means that we will share your name, email address and reference number with Trustpilot for the purpose. Updating information

Please let us know if the personal information which we hold about you needs to be corrected or updated. You may do this by logging into your online Iconic Auctioneers account.

Children’s Privacy

We do not knowingly collect personally identifiable information from anyone under the age of 18. If you are a parent or guardian and you are aware that your child has provided us with personal data, please contact us. If we become aware that we have collected personal data from children without verification of parental consent, we will take steps to remove that information from our servers.

Bidders can attend in person, or alternatively you can bid online, by phone or via commission.

 

When the catalogue is ready there will always be a link on our home page to the E-Catalogue. Printed versions are also posted out to vendors and selected buyers and are available to purchase at the auction.

When selling a car at one of our live auctions we charge a cataloguing fee of £250 plus VAT. The cataloguing fee covers photography, script writing, video and worldwide marketing of your vehicle. Our seller's commission is 7.5% plus VAT (9% including VAT) of the hammer price.

When selling a car or motorcycle in one of our monthly timed online auctions we charge no entry fee or seller's commission - you can list your vehicle for FREE. Buyers will pay us 6%+VAT on the winning bid. see our Timed Online FAQ's for more info (link)

When selling a motorcycle our standard cataloguing fee is £50 plus VAT. The cataloguing fee covers photography, script writing and worldwide marketing of your motorcycle. Our seller's commission is 7.5% plus VAT (9% including VAT) of the hammer price. We also offer a premium service with a cataloguing fee of £200 plus VAT which includes transport of your motorcycle to the auction.

For automobilia, watches and registration numbers we charge a cataloguing fee of £25 plus VAT. Our seller's commission for automobilia items and watches is 15% plus VAT (18% including VAT) of the hammer price, for number plates is 10% plus VAT (12% including VAT) of the hammer price.

Please register for your preferred method as soon as possible (online, by phone or via commission), at least 48 hours before the sale, to allow sufficient time for registration to be processed. Alternatively, you can register to bid in person when you arrive.
